1. Agreement to Terms

By accessing or using Zingad IO (“the Service”) at zingad.io, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid plan holders.

2. Service Description

Zingad IO is an AI-powered marketing tool that helps ecommerce brands create ad copy, email campaigns, Amazon listings, social media content, AI-generated visuals, and other marketing materials. Outputs are generated using large language models and image generation models. The Service is provided on an as-is, as-available basis.

3. Account Responsibilities

When you create an account, you agree to:

• •Provide accurate and complete registration information
• •Keep your password secure and not share access with others
• •Notify us immediately of any unauthorised use of your account
• •Take responsibility for all activity that occurs under your account
• •Be at least 18 years old, or have parental consent if younger

4. Credits, Payments and Refunds

The Service operates on a credit-based system. Credits are consumed when you use AI generation tools. Subscription credits reset monthly and do not roll over. Top-up credits never expire.

• •All payments are processed securely by Stripe.
• •Subscription fees are billed monthly in advance.
• •Credits and subscription fees are non-refundable, except at our sole discretion.
• •If you believe a charge is in error, contact support@zing-ad.com within 14 days.
• •You may cancel your subscription at any time. Access continues until the end of the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• •Generate spam, unsolicited bulk messages, or deceptive advertising
• •Create content that is illegal, defamatory, hateful, discriminatory, or harmful
• •Infringe the intellectual property rights of others
• •Impersonate any person or organisation
• •Attempt to reverse-engineer, scrape, or exploit the platform or its APIs
• •Violate any applicable local, national, or international laws or regulations

We reserve the right to suspend or terminate accounts found in violation of these terms without notice or refund.

6. Intellectual Property

Your inputs: You retain ownership of any product descriptions, brand information, or other content you provide to the Service.

Generated outputs: Subject to these terms and any applicable third-party model licences, the marketing content generated for you belongs to you. You may use, modify, and publish it for commercial purposes.

Our platform: All underlying software, designs, trademarks, and content that make up the Zingad IO platform remain our exclusive property.

7. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will be accurate, complete, or suitable for any specific purpose. AI-generated content should be reviewed before publishing.

8. Limitation of Liability

To the maximum extent permitted by law, Zingad IO and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

9. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will give reasonable notice of material changes where possible. Continued use of the Service after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
